Terms of service
Last updated: 30 October 2026
1. Agreement
These terms are an agreement between you (the coach or academy) and Whistlenote. By creating an account you accept them. If you sign up for an organisation, you confirm you can bind it.
2. The service
Whistlenote provides software to manage sessions, attendance, lesson packages, payment tracking, skill evaluations, reports and a parent portal. We may improve or change features over time. We will not remove paid features without fair notice.
3. Free trial and plans
New accounts get a 14-day trial with Pro features. No payment details are needed to start. When the trial ends you can choose Starter, Pro or Academy, or stop. Plan limits (athletes and coaches) are shown on the pricing page. Prices exclude VAT where it applies.
4. Billing and cancellation
Paid plans renew monthly or yearly until cancelled. You can cancel at any time and your plan runs to the end of the period you have paid for. Except where the law requires otherwise, fees already paid are not refunded for partial periods.
5. Your data and your responsibilities
- You own your data. We process it only to provide the service, as described in our privacy policy.
- You are the controller of your athletes’ and parents’ personal data. You must have a lawful basis to use it, and the consent of a parent or guardian for any athlete under 18.
- You are responsible for keeping login details safe and for what happens under your account.
- You must not use Whistlenote for anything unlawful, to send spam, to harass anyone, or to attempt to break or overload the service.
6. Payments between you and parents
Whistlenote tracks payments you receive; it does not currently collect or hold money on your behalf. Any agreement about lesson fees is between you and the parent or guardian.
7. Availability and support
We work hard to keep Whistlenote available but cannot promise it will be uninterrupted or error-free. We back up data regularly and will tell you about planned maintenance when we can.
8. Intellectual property
Whistlenote and its software, design and brand belong to us. You get a non-exclusive licence to use the service while your account is active. Your content, logos and reports remain yours, and you give us permission to host and display them so the service works.
9. Liability
Nothing in these terms limits liability that cannot be limited by law. Otherwise, and to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability in any 12-month period is limited to the fees you paid us in that period. Whistlenote is a record-keeping tool and does not replace your own safeguarding, insurance or first-aid duties.
10. Ending the agreement
You can close your account at any time and export your data first. We may suspend or end an account for serious or repeated breach of these terms, with notice where practical. After closure, data is deleted as described in the privacy policy.
11. Changes to these terms
If we make a material change we will give account owners at least 30 days’ notice by email.
12. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, without affecting any mandatory consumer rights you have in your own country. [To be confirmed by counsel.]
